The Phase 3 compliance period runs from 6 December 2019 to 5 December 2023, with an extended Compliance date of 5 June 2024.  You will have to comply with ESOS if you meet the qualification criteria on 31 December 2022. If your organisation qualifies for ESOS you must carry out ESOS assessments every 4 years. These assessments are audits of the energy used by your buildings, industrial processes and transport to identify cost-effective energy saving measures

What is ESOS?

The Energy Savings Opportunity Scheme (ESOS) is a mandatory energy assessment scheme, introduced by the UK government to make sure large enterprises in the UK are energy efficient. Under the scheme, large organisations are required to assess their energy usage every 4 years and to find new ways to save energy.

ESOS is separate from the new streamlined energy and carbon reporting (SECR) framework which came into force on 1 April 2019 through The Companies (Directors’ Report) and Limited Liability Partnerships (Energy and Carbon Report) Regulations 2018. Many of the organisations in scope of ESOS will also have SECR obligations that apply to all quoted companies, large unquoted companies and large limited liability partnerships and require disclosure in annual reports of energy, emissions and energy efficiency action taken.

Systems put in place to collect and audit energy use to meet ESOS obligations and progress with the implementation of ESOS recommendations can also help organisations to meet their SECR requirements.

Similarly, there are voluntary schemes to which organisations may subscribe, which could help focus employees attention on energy efficiency and greenhouse gas reduction.  These schemes include Carbon Reduce, Science-Based Targets Initiative and B Corporation Certification.  Act Sustainably can help prepare your organisation to apply for these certifications also and to integrate and streamline your collation, measuring and monitoring systems to optimise efficiency and ROI.

Does ESOS apply to my organisation?

Your company or organisation must comply with ESOS if:

  • You have over 250 members of staff, or
  • A turnover of over 50 million Euros (£44.1m) or an annual balance sheet of over 43 million Euros (£37.9m)
  • You are an overseas organisation with over 250 employees in the UK
  • Your company is part of a larger organisation, which falls into any of the above

ESOS  is managed by the Environment Agency in England, the Northern Ireland Environment Agency, the Scottish Environment Protection Agency, and Natural Resources Wales.
